U.S. Embassy and Consulates Relax Interview Appointment Policy

The U.S. Embassy in Beijing, China reports that non-immigrant visa applicants can now book interview appointments at any U.S. Consular Section in China, regardless of the province or city where they live. Consular Sections are located at the U.S. Embassy in Beijing and U.S. Consulates General in Chengdu, Guangzhou, Shanghai, and Shenyang.

“In 2009, almost half a million people received non-immigrant visas in China, more than ever before,” reports the U.S. Embassy. “The United States government is committed to increasing mutual understanding between the United States and China through people-to-people exchange. We hope the elimination of geographic restrictions on visa applications will promote this exchange by making the visa application process simpler and more convenient.”

Understanding the EB-5 Visa 180 Day Rule

EB-5 visa green card holders – whether the principal, spouse or child – generally need to remain in the U.S. for 180 days per year. There are exceptions such as students studying abroad, medical circumstances or emergency business circumstances. The 180 day rule continues to apply once the conditional residency is elevated to a full green card status.  Only U.S. citizenship can confer the unrestricted travel rules. 

 

The 180 days do not need to occur consecutively, allowing EB-5 visa holders to travel in and out of the U.S.  In fact, a return abroad for up to three months is not unusual for green card holders.  Proper preparation for returning to the U.S. is important.

 

EB-5 visa holders, especially those who frequently travel abroad and may be challenged at the border on their return to the U.S., should carry supporting documentation such as bank account statements, church/synagogue or school records, electrical/utility or phone bills, health and/or car insurance policy, furniture purchases, certificates of title or real estate deed or lease.
